WA State Liquor & Marijuana Law

Miller Malone & Tellefson has over 20 years of collective experience representing clients before the Washington State Liquor and Cannabis Board (WSLCB). Prior to approval of Initiative 502, which authorized state-regulated recreational marijuana, our firm represented a variety of retailers, including bars, restaurants, stadium facilities, hotels; wholesalers; and producers in regulatory and legislative liquor license matters. With the approval of I-502, our firm developed a marijuana licensing and compliance practice and now also represents retailer, processor and producer applicant/licensees before the WSLCB.

Our traditional liquor law practice includes such matters as:

  • Liquor license application assistance for retailers, distributors, importers, brewers, wineries, and distilleries
  • Regulatory compliance advice for liquor laws
  • Defense of liquor licenses in hearings before the WSLCB

Frank Miller has spent over twenty years of his career in the gaming industry. From 1990 through 1997, he served as the Director of the Washington State Gambling Commission. The Commission is one of the largest gambling regulatory agencies in the country; it is a law enforcement agency responsible for regulatory oversight and enforcement of gambling statutes and codes in Washington State. Mr. Miller graduated from Gonzaga Law School in Spokane, Washington. He began his career with the Washington State Attorney General's Office in 1982. In 1984, he was assigned as legal counsel to the Gambling Commission. In 1986, he became the Commission's Deputy Director and in 1988 was given the responsibility of developing the Class III gaming negotiations process in Washington.

In January of 1991, he was appointed as Director of the Gambling Commission. Mr. Miller led the Class III negotiations team for the state, which resulted in nineteen Tribal-State Compacts for Class III Gaming.

He has worked with numerous states and provinces in the development of gaming regulations and programs. In 1995, he was President of the North American Gaming Regulators Association (NAGRA). Prior to his presidency, he served as Vice President and was Chairman of NAGRA's Indian Gaming Committee. Mr. Miller has spoken throughout the U.S. and Canada on gaming regulation and control and is recognized as an expert in the area of gaming law and regulation.

On October 1, 1997, Mr. Miller ended his career with the state to enter private practice. He is the founding member of Miller Malone & Tellefson, a premier legal and consulting firm focusing on gaming law and regulatory compliance.

Dave Malone has been with Miller Malone & Tellefson since October of 1999. Dave's practice focuses primarily on licensing and regulatory compliance matters before the Washington State Gambling Commission, Washington State Liquor and Cannabis Board, and Tribal Gaming Agencies. Dave's clients include gambling equipment manufacturers; commercial card rooms; Tribal gaming, tobacco and liquor operators; non-profit gaming entities; restaurants, bars, and taverns; liquor distributors and producers, off-premise liquor retailers; professional sports franchises; and The Washington State Fair. Prior to joining Miller Malone & Tellefson, Dave worked for the Office of the Attorney General, representing Washington State in a variety of environmental and endangered species projects.

Dave has served on the Board of Directors for the Evergreen Council on Problem Gambling since 2008, including terms as President, Treasurer, and currently as the Executive Vice President. Dave is also an elected Fire Commissioner for Pierce County Fire District 13. In his spare time, Dave enjoys salmon fishing on the Salish Sea.
